Endorsed Schedule of Parcels dated 16.1.2020 (and related endorsed documents) conclusively showed car park L1-18 was an accessory parcel (A220) to Parcel No.568 (Unit D2-808); the 1st Defendant therefore could and should have delivered vacant possession free from encumbrances and the 2nd Defendant's refusal to recognise the sale and reliance on the physical 'Visitor' painting was unsupported by contemporaneous documents; both defendants contributed to the Plaintiffs' loss and liability is apportioned equally; Plaintiffs entitled to the reliefs claimed and costs subject to allocator.
