The High Court allowed the appeal in part: it intervened because the Sessions Court failed to give adequate weight to objective physical evidence (rear impact) and later medical evidence. Liability was reallocated to 80% appellants : 20% respondent to reflect both the rear impact implicating the respondent and other evidence supporting dominant liability on the appellants. Award No.1 for head injury was reduced from RM180,000 to RM100,000 based on more recent expert evidence; awards No.3–No.7 were adjusted by a 15% deduction for overlapping injuries.
