Paragraph 2(b) of the Bar Council's Guidelines is ultra vires because s 80(12) permits procedural rules only and ss 80(8)–(9) authorise relief for losses from dishonesty by any advocate and solicitor; s 111 does not bar challenges to ultra vires acts, therefore the Bar Council's refusal based solely on the sole‑proprietor restriction was unlawful and the Appellants' claim must be reconsidered under the CF Rules.
