The Court found the pleadings against Defendants 2 and 3 to be plainly unsustainable: the defendants demonstrated by affidavit and written submissions that the allegations were speculative, unparticularised and contradicted by contemporaneous material; the recusal order had been obtained and complied with; there was no reasonable cause of action against Defendants 2 and 3 on the pleaded material. Accordingly Order 18 r.19 summary striking out was appropriate and the writ and statement of claim against Defendants 2 and 3 were struck out with costs.
