The Court held that Section 143 does not bar individual unit owners from pursuing individual claims for diminution of value and loss of rental arising from the Embassy tenancy; the High Court erred in striking out the entire action on locus standi grounds. The plaintiffs’ claims concerning diminution of value are individual causes of action whose accrual (for the Embassy tenancy) was around November 2017 and are not necessarily time-barred. The appropriate remedy is to set aside the strike-out and remit the matter to the High Court for trial with liberty to seek amendments to pleadings.
