The Court held that the adjudication decision was enforceable under s.28 CIPAA because the Defendant failed to file a s.15 application to set aside the decision and its allegations of natural justice breaches and excess of jurisdiction were bare and unparticularised; there was no patent non-compliance with CIPAA, therefore the enforcement application must be allowed.
