Although prosecution established a prima facie case and satisfied statutory prerequisites for applying section 37(k) ADB 1952, the accused successfully rebutted the presumption on the balance of probabilities by adducing a consistent, corroborated and probable explanation (early police report D12, wife’s testimony, and subsequent arrest/conviction of brother-in-law for related drug offences) and by pointing to investigative omissions to disprove his version; therefore the court acquitted the accused.
