The prosecution proved, by credible eyewitness testimony and unbroken chain of custody corroborated by chemical analysis, that the accused had possession, control and knowledge of methamphetamine weighing 36.17g; the statutory presumption under s.37D applied and the defence failed to rebut it; accordingly the accused was convicted under s.12(2) DDA and sentenced.
