The High Court held the Magistrate’s 12‑month imprisonment was excessive and that the Magistrate failed to give adequate weight to compelling mitigating factors (guilty plea, first offender status and imminent marriage); exercising sentencing discretion under s427 the Court substituted the imprisonment with a fine of RM3,000, in default 3 months imprisonment, as a proportionate sentence for non‑serious criminal damage of RM374 with no bodily injury.
