On the face of the pleadings there is no privity of contract or pleaded basis for a contractual claim, the allegation of an agreement from 22.10.2021 was unfounded in light of the prior injunction/consent judgment, the claim disclosed no reasonable cause of action and was frivolous/vexatious and an abuse of process; accordingly the defendant's Order 18 r 19 application is allowed and the writ and statement of claim are struck out.
