Although the court found the predicate offence under section 23 MACC Act 2009 established on the balance of probabilities, the applicant failed to prove a sufficient money trail linking the alleged proceeds to the specific RM628,314 in the respondent's account; the respondent provided invoices and delivery evidence showing ordinary course commercial transactions and was a bona fide purchaser for valuable consideration; accordingly the forfeiture conditions in section 56(2)(a)(i) and 56(2)(b) were not satisfied and the application was dismissed.
