The application for private prosecution was dismissed because the alleged s.10 Whistleblower Act offence is seizable (requires police/PP involvement), the Occupational Safety and Health Act and relevant Penal Code offences require prior written consent/fiat of the Public Prosecutor (absence of which invalidates private prosecution), and the criminal proceedings would overlap and risk conflict with existing civil litigation and DOSH's concluded investigation; therefore the magistrate lacked jurisdiction to permit the private prosecution to proceed.
