The strike-out application was allowed because the petitioner failed to prove the mandatory precondition under s106(1) LRA 1976 or establish the proviso (iii) by clear admissible evidence; the available exhibits (incomplete SMS screenshot, uncertain delivery address and JPN correspondence) were insufficient to satisfy the evidentiary burden and the petition was therefore premature and properly struck out under Order 18 r 19 ROC 2012, with liberty to file afresh.
