The appeal is allowed: the learned Judge exceeded Magistrates Court jurisdiction by effectively applying Sessions Court jurisdiction without the required written and filed agreement under SCA s65(3) (applied via s93); the record of appeal was not defective in a manner that prejudiced the respondent and Order 1A could cure the minor index errors; the respondent was not entitled to damages for loss of income beyond the contractual period because he was paid until contract expiry, therefore the award of RM57,000.68 for loss of income was set aside.
