Rule 139 and Form 53 of the Insolvency Rules 2017 constitute a specific procedural exception to the general requirement in Rule 17; therefore the use of a Notice of Application (Form 53) for an annulment under Section 105 is proper where service on the Director General of Insolvency is proved, and there is no statutory time limit for filing such an annulment application; accordingly the application dated 02-08-2023 is allowed with costs.
