Enclosure 23 was set aside because it was obtained ex parte without joining the administrator/registered proprietor, involved material misrepresentation and failure of full and frank disclosure, and sought to relitigate and subvert a final distribution order of the Estate Distribution Officer; the High Court had jurisdiction under Order 32 r6 and its inherent powers and res judicata and the binding effect of the SLA order precluded the amendment establishing the property as part of PSH's estate.
