First Defendant breached professional duties by failing to communicate and to comply with plaintiff instructions to transfer files and to engage with successor solicitors, but plaintiff failed to prove on balance of probabilities that but for that breach it would have succeeded on appeal or suffered quantifiable loss; therefore only nominal damages awarded. Second and Third Defendants were not liable because their retainer was conditional on receipt of cause papers and consent of solicitor on record and those conditions were not met; they did not assume enforceable obligations.
