The respondent failed to satisfy the statutory requirements of Section 15 CIPAA to set aside the adjudicator's decision; accordingly the application to set aside was dismissed. However the court identified an error in the adjudicator's calculation (inclusion of RM150,000 paid for another project) and severed that portion pursuant to Section 28(2) CIPAA, reducing the award from RM506,857.70 to RM356,857.70, which was ordered enforced with interest and adjudication costs preserved.
