The Court found as a matter of law and fact that Defendant used the identical POLO word mark on identical Class 25 goods thereby infringing s 54(1) TMA 2019, and alternatively that Defendant's polo player device signs are substantially similar to Plaintiff's registered device marks used on identical goods in circumstances likely to cause confusion thereby infringing s 54(2)(b) TMA 2019; Defendant raised no bona fide triable issues and summary judgment was appropriate.
