The High Court held the tobacco regulation amending the definition of eating premises and banning smoking within three metres was within the Minister's statutory power under the Food Act 1983, did not violate Articles 5 or 8 of the Federal Constitution, was neither ultra vires nor irrational and the absence of specific additional consultation with smokers did not render the decision procedurally improper; therefore the judicial review application was dismissed.
