Because the challenged decision was that of a public authority and raised public law issues, the claimant was required to proceed by judicial review under Order 53; having pursued and failed in judicial review, filing a writ constituted an abuse of process and the writ disclosed no proper alternative cause of action, therefore the claim was properly struck out under Order 18 r 19.
