The application for leave to issue a writ of seizure and sale was dismissed because the plaintiff failed to comply with Order 15 r 6A(4) by not instituting proceedings against a duly appointed personal representative (rendering the enforcement proceeding a nullity) and because the Sessions Court lacks jurisdiction to issue a writ of seizure and sale in respect of immovable property, which is a matter for the High Court.
