The High Court erred in granting unconditional stays because the respondents did not demonstrate special circumstances going to execution; ordinary hardship, impecuniosity, age or the size of judgment are insufficient; the proper remedy is conditional: payment of the judgment sum into an interest-bearing solicitors' stakeholder account pending the appeals, which neutralises the risk of nugatoriness.
