Non-compliance with subsection 16(1) of the Moneylenders Act 1951 renders the moneylending agreement null and unenforceable; late stamping and payment of penalties under the Stamp Act do not cure that statutory non-compliance; equitable doctrines cannot validate or enforce an agreement rendered unenforceable by statute; consequently any charge or caveat based on the agreement fails.
