The High Court dismissed the judicial review application because the Industrial Court's findings—including credibility assessments that preferred eyewitness evidence (COW1) over the Applicant's witness—were supported by evidence and did not exhibit illegality, irrationality or procedural impropriety; therefore there was no basis to quash the Industrial Court Award and the dismissal was held to be for just cause or excuse.
