The court held that under the statutory scheme LAD is computed from the date of payment of the deposit/booking fee and the contractual statutory period is 36 months; any purported ministerial extension under an ultra vires regulation is void and cannot defeat purchasers' statutory remedies, and equitable doctrines (waiver/estoppel/unjust enrichment) cannot be used to dilute statutory protection; accordingly plaintiffs entitled to LAD and the defendant's counterclaim dismissed.
