The High Court held that the prerequisites for a reference under s.84 CJA and Article 128 FC were met because the question whether Article 14A is inconsistent with Article 10(1)(c) arises directly in the proceedings, relates to the effect of constitutional provisions, and a Federal Court determination would bring finality; accordingly Enclosure 19 (the referral) was allowed and the matter referred to the Federal Court.
