The Court allowed the appeal, set aside the High Court order of 29.5.2023 and reinstated the 2011 judgment because the Air Putih land was not a Malay reserve (so Malay status was irrelevant), and because the respondent failed to prove actual premeditated fraud by the appellant or that the alleged fresh evidence could not have been obtained earlier; the 2017 judge erred in impeaching the 2011 judgment on those grounds.
