The Court of Appeal held the High Court erred in striking out the plaintiffs' common law claims as not plain and obvious; the scope and effect of s31 SOCSO (and interaction with s28A Civil Law Act and deletion of s42) raise factual and legal issues and possible exceptions (notably aggravated/exemplary damages) that require full trial; therefore the strike-out was set aside and the matter remitted to trial.
