JKR owed a duty to road users to maintain Federal roads so as to prevent dangers from wayside trees; evidence showed JKR had assumed and performed such functions and breached that duty by failing to monitor and maintain the dangerous tree causing the plaintiff's injuries; Selia Selenggara was not liable because the concession agreement in effect at the material time expressly excluded landscaping/tree maintenance and JKR had not delegated that duty to Selia Selenggara; the quantum awards were within accepted ranges and not interfered with on appeal.
