The High Court held the Statutory Notice was valid and that the judgment debt constituted a bona fide debt; there was no sufficient bona fide dispute or prospect of irreparable harm to justify a Fortuna injunction, therefore the Originating Summons was dismissed and the purchasers were entitled to pursue winding up enforcement under the Companies Act 2016.
