Defendant lacked locus standi because the Debt was due to RMCD and the defendant was jointly and severally liable under GST Act s53 rather than a creditor of the company; consequently the intended winding-up petition had no real prospect of success and, coupled with the likelihood of irreparable harm and a finding of collateral purpose/abuse of process, justified granting a Fortuna injunction to restrain presentation of the petition.
