Court of Appeal found the trial judge committed serious misdirections by failing to properly consider and evaluate the defence evidence concerning a third party (Adib) and by misdirecting on the burden required at different stages; those misdirections were prejudicial and there was no overwhelming evidence to sustain the conviction for the first charge, therefore the conviction and sentence for the first charge were unsafe and quashed.
