The Magistrate Court Johor Bahru lacked territorial jurisdiction because the cause of action arose in Singapore and the closest nexus of the dispute, witnesses and evidence are in Singapore; the defendants' addresses in Johor did not override the territorial principle and plaintiffs' inability to sue in Singapore due to limitation did not justify maintaining the suit in Malaysia; accordingly the defendants' application to set aside the writ and statement of claim was granted and costs awarded.
