The Court refused to grant a stay under s 44 CJA because CIPAA confers a statutory right to adjudication that cannot be contracted out by a DAAB clause; the High Court did not err in refusing the stay and contractual dispute resolution tiers cannot bar statutory adjudication absent a plain and obvious lack of CIPAA jurisdiction.
