The claim against the 5th to 7th defendants was struck out because the plaintiff failed to plead the essential elements and particulars of conspiracy and fraud against them, did not produce prima facie evidence to sustain fraud allegations at interlocutory stage, could not invoke section 540 against a corporate defendant or individuals not shown to have carried on Surrealist's business to defraud, and provided no basis to pierce the corporate veil; therefore the claim was plainly and obviously unsustainable.
