On the available pleadings and exhibits the court found reasonable doubt as to the genuineness and timing of the LOUs and that the contractual preconditions for payment were not satisfied (no transfer of properties to Defendant, no partition and no issuance of individual titles); accordingly the claims were plainly unsustainable and were struck out under Order 18 r.19(1).
