Because KKM 2012 deliberately omitted the word 'petition' from O.18 r.19(3), the Court concluded that cancellation/strike-out of winding-up petitions is not properly made under O.18 r.19 KKM 2012; control of winding-up petitions is governed primarily by the Companies Act 2016 and related winding-up rules (including powers under s469 and s470) and the inherent power in r92(4) was not engaged on the facts. Therefore the KM13 strike-out application under O.18 r.19 was dismissed.
