On the balance of probabilities the court held Altratec was a bona fide purchaser with registered title and appellants failed to prove actual fraud, forgery or conspiracy sufficient to defeat indefeasibility under s.340 National Land Code; appellants were entitled only to relief limited to the access road issue (declaration of reserved access and orders to remove obstructions) but not to void the 2018 sale or to a proprietary vesting/trust of the access in their favour; appellants’ counterclaims seeking to set aside the sale and for punitive damages were dismissed.
