The summons in the present case is a new summons premised on written permission dated 20.8.2024; because that permission and the subsequent filing occurred after the 150-day statutory limit from sample procurement (6.7.2023), the prosecution is time-barred under s19(2) Food Act 1983 and the charge must be dismissed; s254A CPC does not revive the prosecution because witnesses had not been called and earlier DNAA orders arose from prosecutorial filing errors rather than an ongoing properly instituted prosecution.
