The Court of Appeal found the High Court correctly exercised its discretion under section 310 CPC: the Public Prosecutor made a genuine, bona fide filing mistake, re‑filed the petition once the error was known, the delay was not excessive, no material facts were concealed and substantial justice (including public interest) favored allowing the appeal; accordingly the appeal against the High Court's order was dismissed and the High Court decision of 15 May 2025 was affirmed.
