The will, read as a whole, establishes the plaintiff as the sole beneficiary of the deceased's estate; the provisions allegedly creating a trust for grandchildren only operate if the plaintiff predeceased the testator and therefore do not arise; there is demonstrable hostility, distrust and inability to co-administer the estate effectively between plaintiff and defendant, amounting to 'sufficient cause' under s.34 PAA 1959 to remove the defendant as co-executor and to amend the grant in favour of the plaintiff; accordingly the plaintiff's application is allowed.
