The court held that the suspended detention order contained an illogical and incorrect date (predating the principal detention order) which constituted procedural non-compliance in a preventive detention context; because liberty is concerned the respondents had the burden to ensure procedural correctness and failed to do so, therefore the detention order and suspended detention order were unlawful and were quashed by certiorari.

The court found the grounds of the detention/suspended detention order did not aver that the applicant was a member of a 'substantial body of persons' engaged in trafficking as required by the Long Title, Preamble and Article 149 read into s6(1) DDSPMA; further unresolved contradictions in respondents' affidavits concerning compliance with paragraph 3(2)(c) DDSPMA entitled the applicant to the benefit. Those deficiencies vitiated the legality of the order and justified allowing the judicial review application.
