The Court held the disciplinary process complied with the 1993 Regulations; suspension under s78(1) Police Act 1967 was lawful; the DNAA did not preclude disciplinary action because the criminal charges were different from the disciplinary charges; the applicant was afforded adequate opportunity to be heard by written representation in accordance with Art 135(2); and the dismissal was proportionate to the misconduct; accordingly the judicial review applications were dismissed.
