The Notice of Taxation and Bill of Costs were consequential proceedings to quantify costs awarded by the 16.12.2013 Sessions Court judgment; therefore s.6(3) Limitation Act 1953 (12 years for actions upon judgment) governs and the taxation filed on 3.12.2020 was within that period. O.59 ROC 2012 does not fix a strict filing deadline for taxation and there was no unjustified delay or demonstrable prejudice to the defendants; accordingly the striking out application fails.
