Defendant failed to discharge the burden of raising a real and bona fide triable issue: the Settlement Agreement is not within the Schedule of the COVID-19 Act so the statutory protections do not apply; the defendant did not prove frustration or sufficient evidence of inability to perform caused by COVID-19 measures; the dishonour/cancellation of the three post-dated cheques constitutes breach. Therefore summary judgment for the Plaintiff was appropriate.
