The 1 October 2019 notice constituted a final termination of work on RTGs 2-4 but gave no reasons and was therefore unlawful; the defendant failed to prove the pleaded deadlines or non-completion of TC13 on the balance of probabilities; consequently the defendant's counterclaim is dismissed and the plaintiff is entitled to recover for work done on TC13 with damages assessed on a quantum meruit basis.
