The court found prosecution proved all elements of theft under s.379 beyond reasonable doubt: items were movable property belonging to AEON, accused was found in possession of those items soon after removal from store, could not account for possession or produce proof of payment, and the evidence of identification by witnesses and price tags established lack of consent; amendment to s.379 was lawful and not prejudicial; therefore accused convicted and sentenced to a fine of RM4000 with 12 months imprisonment as alternative.
