Because the court had issued a clear 'unless order' at the PTCM directing interlocutory applications to be filed by 07.01.2024 and Defendant made no timely application or indication at subsequent PTCM dates, the late filing (Lampiran 26) in April 2024 constituted an intentional and contumelious failure and prejudiced the Plaintiff; accordingly the court enforced the unless order under Order 34 r.2(3) KKM 2012 and cancelled Lampiran 26 without costs, maintaining the trial dates.
