On a holistic evaluation the plaintiff failed to prove allegations on the balance of probabilities: material contradictions in the plaintiff's recorded statements, limited and potentially biased expert assessment, absence of conclusive medical evidence of abuse and the welfare report negating neglect/abuse reduced the evidential weight of plaintiff's case. Accordingly the claim was dismissed and costs awarded to defendants.
